Nebraska Security Deposit Law — Explained
The 14-Day Return Deadline
Under Neb. Rev. Stat. § 76-1416, landlords have just 14 days after the tenant moves out and provides a forwarding address to return the deposit along with an itemized statement of any deductions. This is one of the fastest turnaround requirements in the United States, giving landlords very little room to delay.
Deposit Limits and the Pet Exception
Nebraska caps security deposits at 1 month's rent for tenants without pets. However, if the tenant has a pet, the landlord may collect up to 1.25 months' rent — the extra quarter-month covers potential pet damage. This pet deposit exception is relatively uncommon among states and is worth knowing about before signing a lease.
What Your Landlord Can Deduct
Landlords may deduct for unpaid rent and damage beyond normal wear and tear. They must provide a written, itemized list of deductions within the 14-day window. Normal wear and tear — minor scuffs, faded paint, carpet worn from regular use — cannot be charged to the tenant.
Penalties for Wrongful Withholding
Nebraska distinguishes between unintentional and bad faith violations. For unintentional failures, the tenant can recover the amount owed plus court costs and attorney fees. For willful, bad faith withholding, the penalty increases to the amount owed plus 1 month's rent or 2x the deposit amount (whichever is less), plus court costs and attorney fees. This tiered system rewards tenants who can demonstrate their landlord acted in bad faith.
What to Do If Your Landlord Won't Return Your Deposit
- 1Document everything before you leave Take timestamped photos and video of every room. Keep your lease and all communications.
- 2Provide your forwarding address in writing The 14-day clock starts when the landlord receives your forwarding address. Send it via certified mail or email with a read receipt.
- 3Send a formal demand letter after 14 days Use RenterCalc's demand letter generator citing Neb. Rev. Stat. § 76-1416. This establishes a paper trail for any bad faith claim.
- 4File in small claims court Nebraska's small claims limit is $3,600. If the landlord acted in bad faith, you can recover up to 2x the deposit plus attorney fees and court costs.
