Idaho Security Deposit Law — Explained

The 21-Day Default Deadline

Under Idaho Code § 6-321, landlords have 21 days after the tenancy ends and the tenant vacates to return the security deposit or provide an itemized statement of deductions. This deadline can be extended to up to 30 days if both the landlord and tenant agree in writing — typically in the lease itself.

What Your Landlord Can Deduct

Idaho landlords may deduct for unpaid rent, cleaning costs to restore the unit to its original condition, and damage beyond normal wear and tear. The landlord must provide an itemized statement of all deductions. Normal wear and tear — minor scuffs, faded paint, carpet worn from regular use — cannot be charged to the tenant.

The Either/Or Penalty Structure

Idaho provides a strong but unusual penalty. If a landlord wrongfully withholds a deposit, the tenant can recover up to 3x the amount wrongfully withheld. However, this is an either/or remedy: you get treble damages OR attorney fees and court costs, but not both. This means tenants need to strategically choose which remedy provides the greater recovery.

No Deposit Cap

Idaho does not limit how much a landlord can charge as a security deposit. While most landlords charge 1–2 months' rent, there is no statutory maximum. This makes it especially important to negotiate deposit amounts before signing a lease and to document the unit's condition thoroughly at move-in.
