The 60-Day Return Deadline
Under Ala. Code § 35-9A-201, Alabama landlords have 60 days after the tenancy ends to return the security deposit. This is one of the longest deadlines in the country — most states require 30 days or less. The landlord must provide an itemized list of any deductions along with the remaining balance.
Deposit Cap: 1 Month's Rent
Alabama caps security deposits at 1 month's rent. This is one of the lower caps in the country, which is good for tenants at move-in. If your landlord charged more than 1 month's rent, you may be entitled to a refund of the excess.
What Your Landlord Can Deduct
Alabama landlords may deduct for unpaid rent and damage beyond normal wear and tear. Normal wear and tear — minor scuffs, faded paint, carpet worn from regular use — cannot be deducted. The landlord must provide an itemized statement of all deductions.
The 2× Penalty
If an Alabama landlord wrongfully withholds a deposit, the tenant can recover 2× the original deposit amount. Note that this is based on the original deposit, not just the amount withheld — which can be a significant sum. This penalty provision gives tenants meaningful leverage in disputes.
